Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

 

Entry is only open to on-premise venues in Australia who are invited by the Promoter to participate in the promotion (each an “Eligible Venue”). For clarity, in the event that a venue has both an off-premise and an on-premise arm, the off-premise venue will NOT be classed Eligible Venue and sales through the off-premise venue cannot be included in this promotion.  The Prize Taker (defined below in clause 21) must be available to travel in March 2026 for the prize.

 

All of the Promoter’s products purchased as part of this promotion must be purchased from a representative of the Promoter.

 

Employees (and their immediate families) of the Promoter, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

 

Entries into the promotion open on 01/07/2025 and close at 11:59pm AEDT on 31/10/2025 (“Promotional Period”).

 

To participate in this promotion, Eligible Venues that agree to the promotion with an authorised wholesaler from the Sazerac Field Team, at any point during the Promotional Period, and then satisfy all of the following eligible criteria (“Eligibility Criteria”):

 

Purchase 2 x cases of Fireball 1L or 700ml (“Eligible Product”) from an authorised sales representative of the Promoter during the Promotional Period;  

Maintain compliance with all four steps of “Fireball Four” throughout the Promotional Period, as follows:

 

Visible promotional pricing: Display approved Fireball POS materials identifying promotional pricing; 

Bottle on Back Bar: Display the Eligible Product on the shelves behind the bar;

Served Cold: Serve the Eligible Product to customers cold; and

Additional visibility items: Display approved Fireball branded point of sale materials in the venue.

Increase volume of Fireball by the end of the Promotional Period, compared to the same period the previous year (01/07/2024 to 31/10/2024).

 

The Sazerac Field Team will record if an Eligible Venue has purchased the required 2 x Eligible Products and maintained compliance with Fireball Four. The Sazerac Field Team will also check at the end of the Promotional Period whether the Eligible Venue has increased their volume during the Promotional Period compared the same period the previous year.

 

Multiple entries are permitted subject to the below. Each entry must be submitted in accordance with entry requirements. The number of entries Eligible Venues will receive will depend on the following:

Satisfying all Eligibility Criteria = 1 entry

For every additional 2 x cases of Eligible Product (on top of the initial 2 x cases of Eligible Product required to satisfy the Eligibility Criteria) = 1 bonus entry

 

The Promoter reserves the right, at any time, to verify that the Eligible Venues are adhering to the Eligibility Criteria and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

 

Incomplete or indecipherable entries will be deemed invalid.

 

If there is a dispute as to the identity of a Prize Taker (defined below), the Promoter reserves the right, in its sole discretion, to determine the identity of the Prize Taker.

 

The draw will take place at Level 3, 162 Collins Street, Melbourne VIC 3000 on 17/11/2025 at 12pm AEDT in the presence of an independent scrutineer. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible venue is drawn. The winning Eligible Venue will be notified by email and phone within two (2) business days of the draw. The name and postcode of the winning Eligible Venue will be published at https://fireballjapanholiday-tradeincentive.com/ on 21/11/2025.

 

The Promoter’s decision is final and no correspondence will be entered into.

 

The first valid Eligible Venue drawn will win a trip for two (2) people to Tokyo, Japan valued at up to AU$17,250, depending on date and point of departure.  Prize includes:

2 x return economy airfares from Prize Taker’s nearest capital city to Tokyo, Japan;

All airline and airport taxes;

Return private transfers from airport to accommodation in Hakuba;

Snow Machine Festival and Accommodation package including:

5 x nights accommodation in Hakuba;

4 x Snow Machine Festival day passes for 2 people;

2 x day ski lift passes for 2 people;

4 x day high performance (demo/power/mountain) Ski/Snowboard Package for 2 people (ski, poles, boots, jackets, pants, helmet OR snowboard, boots, jacket, pants and helmet).

AU$1,000 spending money (for the Prize Taker only) awarded in the form of an electronic funds transfer to the Prize Taker’s nominated Australian bank account in the Prize Taker’s name.

 

Additional spending money, meals, taxes (excluding airline and airport taxes), insurance, passports, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken in March 2026 (exact dates to be specified by the Promoter at a later date) and is subject to booking and flight availability.

 

The Prize Taker’s companion must be aged 18 or over to participate in the prize. The Prize Taker and their companion are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. The Prize Taker and their companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The Prize Taker may be required to present their credit card at time of accommodation check in.

 

Subject to the terms and conditions of the participating prize provider(s), if for any reason the Prize Taker does not, once the prize has been booked, take the prize (or an element of the prize) at the time stipulated, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.

 

In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster or unforeseeable event beyond the reasonable control of the Promoter, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory authority.

 

The Prize Taker of the Ski/Snowboard Package prize component (“Activity”) and their companion acknowledge that the Activity is a dangerous activity that may result in injury or death, and participate at their own risk. The Prize Taker and their companion must: (a) attend, undergo and pass any appropriate training, briefings, required medical tests and other requirements of the Promoter and Activity organisers as determined by them in their absolute discretion; (b) not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in the Activity; (c) not be under the influence of drugs or alcohol; (d) comply with all directions of the Promoter and Activity organisers at all times; and (e) wear all safety and other equipment required. The Promoter and Activity organisers, in their absolute discretion, at all times reserve the right to: (a) prevent any winner or their companion from participating in the Activity if, at any time, they reasonably believe that the winner or their companion pose a safety risk or for any other reason; and/or (b) cancel the Activity if the conditions are deemed dangerous. If the Activity is varied for any reason beyond the control of the Promoter it may not be rescheduled and no compensation will be offered.

 

Liability for any tax (other than FBT) arising out of participation in this promotion (including acceptance of a prize) is the sole responsibility of the Prize Taker. The Prize Taker should seek independent financial advice in this regard.

 

The Promoter encourages consumers to enjoy responsibly.  Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au. Entry and continued participation in this promotion is subject to the licensee’s liquor serving policy.

 

Prizes will be awarded to the owner of the respective winning Eligible Venue who may, in their absolute discretion, allocate the prize to any employee of that store (“Prize Taker”). The owner must notify the Promoter of that transfer (in writing) within two (2) weeks of being notified of the prize and must not issue the prize without the Promoter’s approval. Approval of the transfer is at the Promoter’s sole discretion.

 

Subject to the unclaimed prize draw clause, if for any reason the Prize Taker does not take / redeem the prize (or an element of the prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

 

If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

 

The Snow Machine Festival passes are subject to the venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject the Prize Taker (and/or their companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.

 

Total prize pool value is up to AU$17,250.

 

Prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

 

A draw for the prize, if unclaimed, may take place on 17/12/2025 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winning Eligible Venue, if any, will be notified by email and phone within two (2) business days of the draw. The name and postcode of the winning Eligible Venue will be published at https://fireballjapanholiday-tradeincentive.com/ on 19/12/2025.

 

Eligible Venues consent to the Promoter using their name, likeness, image and/or voice in the event they are a Prize Taker (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

 

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Venue; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

 

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

 

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a Prize Taker or winning Eligible Venue; (f) if the Snow Machine Festival is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; or (g) use / taking of the prize.

 

As a condition of accepting the prize, the Prize Taker (and their companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.  In the event a Prize Taker or Prize Taker’s companion is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.

 

The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://sazerac.com.au/privacy-policy/.  In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Venue. The Privacy Policy also contains information about how Eligible Venues may opt out, access, update or correct their PI, how Eligible Venues may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia.
